How to Sell a House in Scotland

In Scotland you commission a Home Report before marketing, market at an offers-over or fixed price, receive formal written offers through solicitors, and become legally bound when missives conclude — which happens earlier and more firmly than exchange does in England.

1. Commission the Home Report

With limited exceptions, a property cannot be marketed in Scotland without a Home Report. It contains a single survey and valuation, an energy report and a property questionnaire you complete yourself.

The valuation inside it shapes buyer expectations and lender decisions, so it is the single most important document in the sale.

2. Instruct a solicitor early

In Scotland the solicitor is central from the start, not just at the end. Offers are made and accepted in writing between solicitors, so having one instructed before launch avoids losing days at the point that matters.

3. Agree the asking strategy and market

Most Scottish properties are marketed at offers over, some at a fixed price. The strategy should follow the Home Report figure and comparable evidence, not optimism.

Marketing typically runs across ESPC and the national portals with photography, a floor plan and the Home Report available on request.

4. Notes of interest and a closing date

Interested buyers have their solicitors note interest. Where several parties are interested, your solicitor may set a closing date at which all offers are submitted by a stated time.

You are not obliged to accept the highest offer, or any offer — conditions, entry date and the buyer's position all count.

5. Missives and conclusion

The offer and the responses to it are the missives. When missives conclude, both sides are legally bound. There is no equivalent of gazumping once that point is reached.

6. Settlement and entry

On the date of entry the price is paid, keys are handed over and the title transfers. Your solicitor deals with redemption of any mortgage and registration.

How is selling in Scotland different from England?
The seller provides a Home Report up front, offers are formal written documents between solicitors, and both parties become bound when missives conclude rather than at exchange.
Can a buyer pull out after their offer is accepted?
Before missives conclude, yes. After conclusion, withdrawing is a breach of contract with financial consequences.
How long does selling take in Scotland?
It depends on the property, the buyer's position and the entry date agreed. Time to a concluded bargain varies considerably by area and price bracket.
