Can I sell my house before repossession in Scotland?

The short answer
In most cases a homeowner can sell while arrears are being dealt with, and lenders often prefer it to a court action. Repossession in Scotland goes through the sheriff court, and lenders must meet pre-action requirements before raising proceedings. Speak to your lender and to a free debt adviser immediately — options exist at every stage, and doing nothing is the only one that removes them.
What this means
Repossession is not automatic or instant. A lender must show the court it has complied with pre-action requirements, including providing information about the arrears and considering reasonable proposals.
A sale on the open market almost always produces more than a court-ordered sale, because the property is presented properly and marketed to ordinary buyers.
Independent debt advice is free in Scotland. It is worth taking before any conversation about selling, because a repayment or forbearance arrangement may make a sale unnecessary.

- Ask the lender for the arrears figure, the redemption figure and what it will accept.
- Open every letter from the court or the lender and note the dates.
- Establish whether the property has equity once selling costs are counted.
- Attend any court hearing, or make sure you are represented — the sheriff can take your circumstances into account.
- Compare a normal sale against a faster sale on net proceeds, not headline price.
